Terms of service

This page is not legal advice. If you and Githon LLC sign a written agreement, that agreement takes precedence over this page.
These terms cover the fastcade.com website and the Fastcade service at admin.fastcade.com. When we say “you”, we mean the merchant that uses Fastcade and the people who use it for that merchant.
Who these terms are with
Githon LLC, a Wyoming company, provides the website and the service. By using either, you agree to these terms. Sending the request access form does not create an account or a contract.
The service
Fastcade is available by invitation only. Its features can change over time.
Accounts
You are responsible for the users you add and for keeping their sign-in details safe. If you think an account was misused, tell us at hi@fastcade.com at once.
Your responsibilities
You agree that:
- You use the service lawfully.
- You have the right to the data you bring into the service.
- You have told your customers and drivers how their data is used, including location tracking and delivery photos.
- Your settings, such as cutoff times and calendars, are correct.
Acceptable use
Do not use the service to break the law, send spam or harm other people. Do not try to break into, overload or get around the security of the service. Do not misuse the request access form, for example with automated submissions.
Third-party services
Fastcade works with services from other companies.
- Shopify and Onfleet run under their own terms.
- Fastcade alone is responsible for the Fastcade service. Shopify is not responsible for it and does not support it.
Fees
Fees are set in a written agreement with you. During the invited trial, we do not charge for the service.
Your data
How we treat your store data:
- Your store data belongs to you.
- You give us a limited license to use it only to provide and improve the service, as our Privacy policy describes.
- A data processing agreement is available on request.
Our intellectual property
The Fastcade software, website and brand belong to Githon LLC. These terms do not transfer them to you.
Confidentiality
Each of us keeps the other’s non-public information confidential, and uses it only for the service. This does not cover information that is already public, or that the law requires us to disclose.
Availability
We work to keep the service running, but we do not offer a service level agreement (SLA). The service is provided as is.
Disclaimer
To the extent the law allows, the website and the service are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose.
Limitation of liability
To the extent the law allows:
- Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.
- We are not liable for indirect or consequential losses, such as lost profits, lost revenue or lost data.
Indemnity
Each of us is responsible for claims that come from our own breach of these terms or our own breach of the law.
Ending the service
How the service ends:
- Either of us can end the service at any time by telling the other by email.
- Before it ends, you can ask us to export your store data.
- When the service ends, tell us and we delete your store data within 30 days. You can also ask us to delete it at any time.
Changes to these terms
We may change these terms. We tell you about a material change by email before it takes effect, and we update the date at the top of this page.
Governing law and disputes
The laws of the State of Wyoming govern these terms. Disputes go to the state or federal courts located in Wyoming.
